德国采用的是绝对责任(strict liability)原则,即机动车车主(未必是事发时的驾驶员)无责亦须赔偿原则。豁免条件只有:1. 不可抗力;2. 肇事驾驶员未经车主合法授权而驾驶车辆(比如车辆被盗)。德国道路交通法Section 7规定:SECTION 7. LIABILITY OF VEHICLE HOLDER (FAHRZEUGHALTER), CLANDESTINE OPERATION OF A VEHICLE (1) If, during the operation of a motor vehicle or a trailer to be carried along by a motor vehicle, a person is killed, the body or health of a person injured, or property is damaged, the holder (Halter) of the vehicle is obligated to compensate the injured person for the damages arising therefrom. http://www.cgerli.org/fileadmin/ ... oad_Traffic_Act.pdf

In accordance with the German Road Traffic Act (Straßenverkehrsgesetz), the holder of a motor vehicle is strictly liable for the damage caused by him when using the car, even if he cannot be blamed for the accident. A motor vehicle is in use for so long as it is in traffic and exposes other road users to danger. The holder of the car is not liable if he can prove that the accident was caused as a result of force majeure. The strict liability does not apply to passengers.美国、加拿大采取的是相对责任原则,即按照事故双方的过错比划分责任。
中国和美国类似,但机动车一般需要付至少10%的责任。
欧洲国家采取绝对责任原则的有:法国、德国、比利时、意大利、西班牙、荷兰、奥地利等。采取相对责任原则的有:英国、爱尔兰、塞浦路斯、马耳他、罗马尼亚等。需要注意的是,英国规定的是行人有权在任意地点过马路,而且行人可以和机动车一样的权力使用道路,即英国行人在机动车道上行走是合法的。所以即使按照相对原则,司机要完全免责也是不大可能的。另外几乎所有国家都规定了在如果在一定距离内没有人行横道,行人是可以横穿马路的(高速公路除外)。德国是0,比利时、丹麦是30米,法国、瑞士是50米,意大利、斯洛文尼亚等是100米。
